A judge has ruled that Arizona has the authority to sue the Maricopa County Community College District over offering in-state tuition to young immigrants granted deferred deportation by the Obama administration.
In a ruling filed Wednesday, Maricopa County Superior Court Judge Arthur Anderson said Arizona Attorney General Tom Horne was acting properly at the direction of Gov. Jan Brewer to see that the law was being "faithfully executed."
Opponents of the policy say that extending reduced tuition to so-called Dreamers violates a state law that prohibits any immigrant without legal status from receiving public benefits.
Attorneys for one of the nation's largest community college systems had argued that governor's obligations did not extend to the school's policies.
State officials first filed the lawsuit in June.
